Permanently Brain Damaged Teen Awarded $49M After Horrific California Truck Accident

A California jury awarded a permanently brain damaged teenager $49 million after he was involved in a multi-truck accident on Pacheco Pass. In addition to the $49 million damages award, the California Department of Transportation and one of the trucking companies settled their portions of liability with the teen for an additional $12 million, bringing the total award to $61 million – a great deal of which will be needed for his future neurological treatment and round the clock care for the rest of his life.

The details of this California truck accident lawsuit are horrific. According to news reports, 23 year old Drew Bianchi was in the back seat of a Toyota Avalon in May 2007 heading out on a camping trip with three of his friends. While on California's Highway 152 going through Pacheco Pass, two trucks collided with each other just as the Toyota neared the scene. The truck accident left Bianchi, who was working towards becoming a physician and was about to start school at the University of California – Davis, permanently brain damaged.

Teen receives over $60M

His family filed a lawsuit against both trucking companies, their drivers and the California Department of Transportation (Caltran) for failing to improve conditions on Pacheco Pass which had become known as “blood alley” due to the number of accidents which have occurred in that area over the years.

Caltran settled with Bianchi for $10 million and one of the trucking companies – whose driver admitted crossing the center line – settled for $2 million. However, the other trucking company refused to settle and the lawsuit went to court. Bianchi's California personal injury lawyer was able to prove to the jury that the trucker was driving recklessly and talking on his cell phone at the time of the accident. The jury awarded Bianchi $49 million for his future neurological treatment and the round the clock care that he will require for the rest of his life.
