Can I sue my employer if I was injured during a construction site accident? Or is this likely to be a worker’s compensation claim?

In many states, if you are an employee, you would not be able to sue your boss directly; instead, a worker's compensation claim would be the method for seeking a remedy. The paperwork and rules differ in these cases. There are attorneys who specialize in worker’s comp cases, and they will know what restrictions there are in your state that may not apply to ordinary injury cases.

Of course, as in other cases, you’ll need to determine who is liable. Even if you can’t sue your boss, there could be third parties with insurance coverage who may have some responsibility for your injuries, and you can sue them. Often that’s where more money is found. This could include other contractors who were negligent or created a dangerous condition.
