New York Construction Accident Lawsuit settles $4.9M

A New York construction worker who was injured on a demolition project has settled his case against two construction companies and a maintenance firm for $4.9 million. The worker was buried under concrete debris and suffered severe and permanent injuries.

Construction accident personal injury

According to news reports, David Delprince, a 43-year old construction worker was a member of a five person team which was demolishing a 100-year old building in New York and turning the property into luxury condominiums. Delprince was working on the 6th floor of the building when several tons of concrete and wire mesh crushed him. He sustained permanent injuries to his back and now needs help walking. He can no longer work in the same field of employment.

He sued the construction companies hired for the project, as well as a maintenance firm, for the injuries he sustained. The unsafe workplace case made its way to trial, but the parties ended up settling for $4.9 million after just two weeks of testimony.

Inherently dangerous jobs

Construction work is an inherently dangerous job - especially when working at higher elevations like the injured worker in this case. General contractors or owners who fail to provide workers with safety equipment or place them into unreasonably dangerous situations can be held liable for any injuries sustained on the job. In many cases, those general contractors or owners can be held strictly liable for those injuries - which means that they can be held responsible for damages regardless of any fault on their part. An experienced personal injury attorney will be able to determine what causes of action apply in a construction accident case.

Damages can be substantial

Damages in a construction accident case can be substantial and may include loss of earnings, medical expenses, rehabilitative expenses, compensation for the pain inflicted, compensation for permanent disability, compensation for the level of impairment of duties and responsibilities as a spouse or a parent, for permanent suffering such as disfigurement and impairment of quality of enjoyment of life.

If you've been injured in a construction accident, contact an experienced New York personal injury attorney to discuss your situation. Consultations are free, without obligation and are strictly confidential.
