What are the railroad's responsibilities in the area of providing grade crossing protection?
The final decision on the level of grade crossing protection to be provided is subject to federal approval. Therefore, railroads are not usually held liable for the adequacy of such protection. However, the railroads usually install and maintain the protective devices selected, and may therefore be found negligent when a grade crossing accident is found to have been caused in part or in whole from improper installation and/or maintenance of those devices.
