Metrolink Victims’ Recoveries May Be Limited
The horrific Metrolink train accident on September 12th may go down as one of the worst train accidents in U.S. history. Twenty-five people were killed and over 130 were physically injured when a Metrolink train collided with a Union Pacific freight train in Chatsworth, California. As horrific as the accident was, the aftermath for victims and their families may not provide much in the way of recovery.
What types of damages will result?
Injuries that result from an accident such as this one cannot be generalized. Most of the damages in these cases will likely focus on pain and suffering or loss of consortium. Protecting victim rights
Ledger and others from his firm have been at the scene of the accident and have walked the now flower-lined Chatsworth tracks. However, even through the NTSB is there, they have their own investigators at the scene to protect the rights of victims and their families.
Another way that the firm plans to protect victims’ rights is by challenging the constitutionality of the Amtrak Reform & Accountability Act which was signed into law by President Clinton in 1997 which limits the amount of damages available in Amtrak train accidents to $200 million for everyone involved. Ledger says that while that may be fine when only a few people are injured, it doesn’t provide the amount of relief needed in a horrific situation like the one in Chatsworth.
