New York Truck Accidents

The New York State Department of Motor Vehicles reports that in 2005 alone, there were nearly 8,000 large truck accidents in the state involving over 16,000 vehicles. When a truck accident occurs, complex factors come into play. A New York truck accident is more complicated than a standard auto accident due to the presence of multiple parties such as the truck driver, owner, manufacturer, insurance company, and the manufacturers of truck components such as tires and brakes. These multiple parties can make negotiations and determination of fault a lengthy and often expensive process.

State and Federal Regulations

New York truck accidents are covered by state and federal regulations and laws and national commercial trucking standards that can even further complicate the issue of fault. National agencies such as the U.S. Department of Transportation (DOT) and Federal Motor Carrier Safety Administration (FMCSA) regulate and oversee interstate and in-state truck traffic. In addition, there are overarching insurance regulations for all truckers: any truck that crosses state lines must by federal law carry at least $750,000 in insurance coverage in case of injury or property damage. These numbers may be even higher for hazardous loads. New York state has also adopted these federal insurance standards; in addition, New York has its own inspection and safety requirements that can come into play in a New York trucking accident.

New York Truck Accident Lawsuits

If you’ve been involved in a New York truck accident, it’s essential that you get in touch with an experienced New York truck accident lawyer as soon as possible. Your New York truck accident attorney will have specialized knowledge of insurance, fault, regulatory and safety issues. He or she will have experience conducting a specialized investigation that can uncover circumstances and factors including traffic conditions, driver fatigue, and/or drug and alcohol use. A good New York truck accident lawyer can also help deal with cargo owners, insurance companies, truck manufacturers, and other third parties. These negotiations are part of a larger legal strategy that can lead to a settlement or favorable verdict that provides compensation for injuries or property damage associated with a New York truck accident.
