My son was in a coma for months because of a car wreck. He was 18 then and now he is 20. Does the time period for filing suit apply to a person who was in a coma and is just realizing what happened?
This is one of those extremely rare exceptions to the statute of limitations. Under the laws of most states, your son, while in a coma, is "incompetent" and not able to look after his interests. The time during which an adult plaintiff (your son was 18 at the time of the accident, and so an adult) is mentally incapacitated and lacks a conservator or guardian with authority to prosecute the claim is not counted in computing the statute of limitations. However, the clock began to run the moment he became aware of his injuries and remembered that the car accident caused them. Because of the complexity of the case, he should consult an experienced car accident attorney.
