Do I have to go to arbitration for my car accident injury?

Some states and many insurance companies require "mandatory arbitration" of disputes arising out of car accidents. Evidence is presented outside of court to neutral arbitrators. The arbitrators then determine the amount of the award. If both parties agree to the arbitration award, the matter ends. If either party refuses to accept the arbitration award, the unhappy party may sue to have a new trial in a court of law, with liability to be determined by a judge or jury. Arbitration ideally functions to save time and money for all parties.
