It depends. If the accident occurred in California, then admiralty law probably wouldn't apply. The 9th Circuit Court of Appeals in 1993 ruled admiralty law didn't apply where a 15-year old boy dove from the deck of a houseboat and struck something under the water of Snodgrass Slough at the convergence of the Sacramento and Mokelumne Rivers. But admiralty law did apply in the case of a scuba diver who was transported by boat to an open water dive on navigable waters (with a scheduled transport back to shore from the open water dive) and was subsequently injured during the dive. The rules for fault and damages in a water accident may differ between admiralty law and state law.
