Every state sets a time limit within which you must file your lawsuit or lose the chance to do so all together. These time limits are set by law, and these laws are called statutes of limitation. The answer to your question depends on the laws of the state in which you live. Many states have Minors' Tolling Statutes. These statutes extend the amount of time an injured minor has to file a lawsuit. For example, in a state where the statute of limitations is two years and is suspended until an injured child is 18, the injured child would have two years from his or her 18th birthday to file a claim.
