What is "reckless" conduct and what are the legal implications?
Courts tend to be hard on those who act in a "reckless" manner as their behavior may place others in grave danger. For example, suppose a normally careful driver in a hurry to get home after a party was speeding through the streets with a blood alcohol level over the legal limit. If the driver hits and seriously injures a pedestrian, he or she will likely be responsible for the victim's actual damages (lost wages, medical bills, rehabilitation, payment for any permanent injury and pain and suffering) and possibly punitive damages in some states.. However, if the driver hadn't been speeding or driving under the influence and hit the pedestrian by accident, then punitive damages would generally not be an issue.
