While driving next to a golf course that had no fencing, my car’s window was cracked by a golf ball. The course manager claims no responsibility and told me the person who hit the ball is liable (but is impossible to find). Can I sue the owner of the golf course?
Can you sue the golf course owner? Yes. You could probably sue in small claims court and you might even win. However, I am not sure it is worth the time, effort and cost to you for so minor an incident. So the question that is more pertinent here is should you sue?
Replacement or repair to a car window will likely cost $500 or less. Your insurance will likely cover it if you make a claim and you have either separate glass coverage or comprehensive coverage. You will only be responsible for your deductible if you have one. If you don’t have coverage or choose not to make a claim, you will need to cover the cost yourself. Then you have to decide if it is worth it to go to the trouble of suing. If you sue the owner, it will cost you time to prepare your case, a day of work to go to court, filing fees of anywhere from $20 to $100, plus gas to and from the courthouse. If the owner does not pay you should you get a judgment against him, it will cost you more time and money to force him to pay you. For such a minor claim, suing is not always the best option. |
