Arizona's pure comparative fault liability system
Arizona is a pure comparative negligence state when it comes to auto accidents. But what does that mean? Wattel provided the following example:
You take a pie that represents 100 percent of the liability and however many people have some responsibility; their liability has to add up to 100 percent. Other states have contributory negligence, which means that if you have any responsibility as a plaintiff, you dont get to collect.In Arizona, if youre the plaintiff or claimant and you have a comparative responsibility, all it does is lessen the amount that you can collect by that comparative fault. For example, if the scenario is an 80/20 split, 80 percent is the responsibility of the defendant and 20 percent lies on the clients part, the client can still collect 80 percent of their damages from the other driver.
